We send transactional notifications, account alerts, onboarding materials, appointment reminders, operational updates, and promotional marketing campaigns via SMS, MMS, and automated AI voice agents (including systems like Twilio, RingCentral, and Retell AI).

2. User Opt-In and Consent: By providing your phone number online, via a mobile form, or over a phone call with our team or AI agents, you explicitly consent to receive recurring automated messages and AI voice interactions from Garcia N' Associates LLC. Enrollment in this program is strictly voluntary and is not required to purchase any goods or services from us.

3. Message Frequency and Rates: Message frequency varies based on user interaction, account activity, and ongoing promotional campaigns. Standard text messaging and data rates imposed by your mobile carrier may apply to all incoming and outgoing text messages or AI voice calls. Garcia N' Associates LLC is not responsible for any fees charged by your carrier.

4. Opt-Out and Unsubscribe Instructions (STOP): You can cancel and opt-out of our SMS and automated calling program at any time. To opt-out of text messages, reply STOP to any message received from us. To opt-out during an interactive voice or AI conversation, state 'STOP' or request to be placed on our internal Do Not Call list. After replying STOP, you will receive a single final text confirming your unsubscribed status. No further automated messages will be sent unless you re-initiate consent.

6. Carrier Liability Disclaimer: Mobile carriers (including, but not limited to, AT&T, T-Mobile, Verizon, Sprint, and regional network operators) are independent entities and are not liable for delayed, misrouted, or undelivered messages or automated calls.

7. Dispute Resolution, Mandatory Arbitration, and Class Action Waiver: PLEASE READ THIS SECTION CAREFULLY. It affects your legal rights, including your right to file a lawsuit in court. Any dispute, claim, or controversy arising out of or relating to this SMS and automated communications program, including federal Telephone Consumer Protection Act (TCPA) claims, state-level telemarketing claims, or privacy claims, shall be resolved exclusively through final, binding, bilateral arbitration rather than in a court of law. You explicitly waive any right to participate in a class-action lawsuit, class-wide arbitration, or representative legal action against Garcia N' Associates LLC.
